Special counsel Jack Smith issued a subpoena to former Vice President Mike Pence after months of negotiations in a sign that the investigation into the Jan. 6 attack on the Capitol is nearing its "climax," according to legal experts.

Smith, who is overseeing Justice Department probes into former President Donald Trump's Mar-a-Lago documents scandal and the Jan. 6 Capitol riot, requested testimony and documents from Pence related to Trump's failed effort to overturn his election, ABC News and other outlets reported on Thursday.

The subpoena followed months of negotiations between prosecutors and Pence's attorneys, according to the report. The move suggests that the probe is entering a "more advanced stage," ABC News reported, but it's not clear whether Pence may try to use executive privilege claims to fight the subpoena, which could set off a lengthy legal battle.

Gov. Ron DeSantis wanted guns banned from his re-election, but he also wanted the city of Tampa to take the blame for it, which demonstrates that the Florida governor is a Trump clone.


The Washington Post reported:
The Republican governor’s campaign wanted weapons banned from his victory celebration at the city-run Tampa Convention Center, a city official said in emails obtained by The Washington Post. And the campaign suggested that the city take responsibility for the firearms ban, the official said — not the governor, who has been a vocal supporter of gun rights.

“DeSantis/his campaign will not tell their attendees they are not permitted to carry because of the political optics,” Chase Finch, the convention center’s safety and security manager, said in an Oct. 28 email to other city officials about the request, which was conveyed by the Florida Department of Law Enforcement, a state police agency led by a DeSantis appointee.  DeSantis wanted the city to tell anyone who asked that it was their policy not to allow guns in the building, which was a lie.

Officer took photos of beaten Tyre Nichols 'and sent the photos' to 'a female acquaintance'

In Memphis, five fired police officers — Demetrius Haley, Justin Smith, Desmond Mills Jr., Emmitt Martin III and Tadarrius Bean — are facing second-degree murder charges in connection with the death of Tyre Nichols, who, according to prosecutors, was severely beaten on January 7 and died three days later. Details in the case, which has inspired protests all over the United States, continue to emerge. And according to the Associated Press (AP), newly released documents indicate that when Nichols was pulled out of his car that day, Haley “never explained why he was being stopped.”

AP reports, “The Memphis Police Department blasted Demetrius Haley and four other officers as ‘blatantly unprofessional’ and asked that they be stripped of the ability to work as police for their role in the January 7 beating, according to documents released Tuesday by the Tennessee Peace Officers Standards and Training Commission. They also include revelations that Haley took photographs of Nichols as he lay propped against a police car, then sent the photos to other officers and a female acquaintance.”

“Never seen anything like it”: "Aggressive" Trump special counsel hauls lawyers before grand jury

Two of former President Donald Trump's attorneys have reportedly appeared before a federal grand jury investigating the former president's handling of sensitive government documents that he took to his Mar-a-Lago club and residence after he left office.

Trump attorney Evan Corcoran, who handled the former president's responses to the government over its requests for the return of records, was interviewed before a grand jury, The New York Times reported on Friday. Fellow attorney Christina Bobb, who signed an affidavit affirming that Trump had returned all classified materials in response to a grand jury subpoena in June before the FBI found additional documents marked classified during an August search, also appeared before the grand jury, according to The Wall Street Journal.

Special counsel Jack Smith, who was appointed to oversee the investigation into Trump's handling of classified documents and his involvement in the Jan. 6 assault on the Capitol less than three months ago, is "moving aggressively" in the probe before the 2024 presidential campaign gets underway this summer, according to a recent report by The Times. 
Smith's team is also looking to interview Trump attorney Alina Habba, who is not representing Trump in the Mar-a-Lago case but said in an affidavit in another case that she searched the former president's office and residence in May, according to the report.  Prosecutors are also seeking to question former Trump attorney Alex Cannon, who reportedly advised Trump to cooperate with the government's requests to return the documents.

"I've never seen anything like it," Chuck Rosenberg, a former U.S. attorney and senior FBI official, told the Times. "It's just a whirling dust cloud, and everyone who gets near it gets covered in grime."

Former U.S. attorney Joyce White Vance said the report makes it sound like Smith is "fixing to give some Trump lawyers & aides the option of being codefendants or cooperating witnesses."

'Evidence of a crime': Feds file sealed motion compelling Donald Trump's lawyer to testify

Prosecutors for Special Counsel Jack Smith, investigating Donald Trump‘s unlawful retention and refusal to return hundreds of documents with classified markings, are trying to compel one of the ex-president’s attorneys, Evan Corcoran, to testify before a grand jury again. They are asking a judge to allow them to invoke the crime-fraud exception, which voids attorney-client privilege.

The move, in the form of a seal motion, suggests they may have evidence of a crime.

Reported in the media today that Pence has lawyered up and will fight the subpoena. Predictably, the Democrats heaped scorn on him for this.

Adam Schiff Hammers Mike Pence Trying To Dodge Testifying About 1/6


Rep. Adam Schiff (D-CA) called out former vice president Mike Pence for trying to dodge the DOJ and avoid testifying about the 1/6 attack.

Pence is now claiming the Speech and Debate Clause — meant for senators and members — allows him to avoid testifying about Jan 6. Just shows the lengths Pence will go to avoid doing his duty and telling the truth. What a way to launch a presidential campaign.

What Rep. Schiff was referring to is a report in The New York Times that Pence is going to try to argue that his role as president of the Senate gives him speech or debate clause protection:

Mr. Pence is expected to argue that the vice president’s role as the president of the Senate means that he is protected from legal scrutiny of his official duties by the Constitution’s “speech or debate” clause, intended to protect the separation of powers.

Such an approach would be novel and a departure from the more traditional argument that a vice president’s interactions with a president would be subject to executive privilege.
