Patrick Kane Under Investigation - Alleged Rape

Patrick Kane's accuser had bite marks on her shoulders and a scratch on her leg, a source with knowledge of the rape investigation involving the NHLer reportedly told the Buffalo News.

The News detailed the alleged victim's account of what she claims happened inside the Chicago Blackhawks star's Town of Hamburg (N.Y.) home last Sunday.

According to the source, the woman alleges Kane, 26, invited her and a friend back to his home after meeting at a downtown Buffalo bar last weekend. Once there, the accuser claims Kane followed her into a room before allegedly overpowering her and raping her, the source told the News.

The woman reportedly called relatives immediately after the alleged incident. She attended a hospital and a rape kit was conducted.

The owner of SkyBar, where Kane spent a portion of Saturday night, confirmed to the News that he saw a woman paying close attention to the NHLer prior to the incident, which allegedly occurred around 4 a.m. Sunday morning.

As a result of the investigation, Kane has hired lawyer Paul Cambria to represent him, according to the Associated Press. Cambria worked with Kane after the three-time Stanley Cup-winner was accused of assaulting a Buffalo taxi driver in 2009.

If true then Kane should be in jail for a decade or more. What scum.

I believe the penalty for rape in New York is 5-25 years.  So this is very very serious.  If Kane's past assault is still on his record, the D.A. would likely ask for more than the minimum.

It also puts Kane in an interesting position.  If he's charged, as a celebrity who's career would rely on his being acquitted, risking a minimum of 5 years is a big gamble.  Non-celebrities might plea to a lesser charge and count their lucky stars.  If Kane takes a plea and admits to being a rapist, his career is potentially over.  Which means, he'd have to go to trial.  And it will get very very ugly.  The Kane-friendly media is already looking for reasons to blame the victim, like being enamored with Kane at the bar makes it okay to be violently raped, going into a room alone with him makes it okay.

We shall see...

The Blackhawks may have little choice but to suspend Patrick Kane http://on.si.com/1EnvthG

Snippets:

Writing in Wednesday's Chicago Tribune, David Haugh argued that Kane’s uncertain legal status puts the Hawks in an impossible position. With training camp less than six weeks away and the justice system moving at its own deliberate pace, the team may be forced to suspend the star winger.

“In the post-Ray Rice era of professional sports, a first-class franchise such as the Hawks cannot allow a player facing serious allegations to represent it until more clarity about the case exists,” Haugh wrote.

Of course there’s a counter-argument to be made that the player deserves the presumption of innocence until proven guilty and that supporting him is both the ethical and moral stance for the organization to take.

That’s the position the Colorado Avalanche took back in 2013 when their starting goaltender Semyon Varlamov was arrested on domestic violence charges.

But in the wake of the Rice assault incident in 2014, the rising outcry against domestic violence and how it is handled by teams, leagues, colleges and other sports organizations left the Los Angeles Kings with little wiggle room when Slava Voynov was arrested on charges of domestic violence in October of that year.

The situation with Kane is murkier because he has yet to be charged with a criminal offense and it’s entirely possible that he never will be. But taking the Varlamov approach once camp and the season roll around could be a no-win for the Hawks. Allowing Kane to participate in team activities will likely create a distraction that could disrupt camp and the total focus the Blackhawks will need to mount a credible Cup defense. More important, they’d be sending a terrible message about the integrity of the standards that have been set by the organization.

On Wednesday afternoon, EA SPORTS announced that Kane "will no longer be involved as a spokesperson for the launch of...NHL 16."

For Kane, hockey should be the least of his concerns at the moment. He’s better served by focusing on not just this matter, but on the way he wants to lead his life moving forward. His history of unfortunate off-ice incidents is not making any of this easier for him or his team to handle.

I wouldn't suspend him until he's charged.

Easy for you to say but how do you justify that when you are the Blackhawks and this controversy is still raging while you happily line him up on your first line on opening day? There's going to be a lot of pissed off people if they do that.

He has high priced lawyers.  They should force the DA to either charge him or announce the investigation is over with no charges pending.  It really shouldnt take much longer if the evidence is strong.

From rumors/speculation:

- Victim immediately called a relative to report what happened

- Victim was immediately distraught

- Victim immediately sought medical attention & rape kit

- Physical evidence was apparent including bites and scratches

- Physical evidence was apparently captured (presumably from rape kit), awaiting forensic analysis

If the DNA matches Kane and the victim isnt batshit crazy, he will likely be charged.

I wouldnt necessarily suspend him now because there is the chance that a) he wont be charged B) the accuser is nuts.  However, he should be suspended when/if charged.  If the cloud is hanging over him, uncharged, by the time training camp rolls around, they have to make a decision.  It will be a huge distraction if he's there.  I would strongly suspect the team and NHL is well aware of the strength of the evidence at this point.

The fact he hasnt been charged yet might mean the evidence isnt exceptionally strong or the police/DA is being particularly careful in having their ducks in a row.  Knowing Kane has been in trouble before, let's assume he immediately lawyer'ed up and did not speak to the police.  That hampers their investigation a little bit. They might simply be going through the proper and routine steps.

Shouldnt be long, either way, at this point.

It is easy for me to say that.

I can justify it b/c the police don't have sufficient evidence yet. Once they have it and they've charged him he can sit. At that point there's actually something tangible to show that he may have done something wrong.

The woman accusing Chicago Blackhawks star Patrick Kane of rape went to his Hamburg, New York home because her friend wanted to go there, according to a report in The Buffalo News.

Per the story in The News:

“They were at SkyBar, and Kane invited them to his home. Her friend really wanted to go to Kane’s house, and she didn’t want her friend to go there alone,” a friend of the woman told The Buffalo News. “It wasn’t her idea to go there.”

The piece cites two other sources that gave a similar account, a law enforcement official and a member of Buffalo’s legal community.

http://www.hockeyfeed.com/nhl-news/report-hawks-ready-to-move-on-from-patrick-kane/?ref=vanhoutte

According to Barry Rozner of Chicago's Daily Herald, the Blackhawks are preparing for life without their star forward Patrick Kane. The latter is currently under investigation for a sexual assault case that allegedly occurred in his home near Buffalo. Less than three weeks away from training camp, the Hawks are in a very difficult position.

Per Rozner, the Hawks may have to take a decision that won't please their fans, whatever the outcome of the investigation is.

"Kane had been warned about his behavior, and the Hawks were not pleased that he announced at the Stanley Cup rally that he intended to act the fool again while celebrating the team’s third championship in six seasons."

"The brand, the titles and the sweater go hand in hand as far as the Hawks are concerned, but no one player is bigger than the team and the Hawks and their litany of sponsors do not want to be known as a group that values winning above decency."

"They do not want to be the Baltimore Ravens after the Ray Rice debacle, so the Hawks find themselves painted into a corner and Kane is holding the brush", Rozner wrote on saturday morning.

Many fans would be angry if Chicago make such a move, claiming Kane can't be held responsible of anything until proven guilty, and they do have a point. But in the "post Ray Rice" world, public image of the team has become more important than ever and domestic assault cases have to be treated very seriously and rightly so.

The fact that Kane has a troubled past with the law isn't helping either. According to Rozner, the Hawks have been extremely busy about what they plan to do with their superstar since day one of this story. Every single option is currently being studied, from doing nothing to trade him or "every possibilities in between".

Let's just say this is not what the Hawks were hoping for when Kane said he would go wild again after their Cup victory.

http://www.hockeyfeed.com/nhl-news/5-teams-that-could-realistically-trade-for-patrick-kane/?ref=jo

With reports earlier today that 5 teams had contacted the Blackhawks for a potential Patrick Kane trade we immediately began to wonder what teams could make such a deal.

First of all any trade would need to take into consideration Kane's $10.5 million dollar cap hit, meaning that it would either require a team with significant cap space or would require large amounts of salary to be shifted on both sides.

#5 - The Winnipeg Jets

We think this destination is less likely simply because the Jets play in the Western Conference, with that said they certainly have the salary cap space to accommodate a trade of this magnitude.

Many believe that Blackhawks general manager Stan Bowman's decision to trade Brandon Saad to Columbus was prompted by contract demands he believed were too high. Could trading Patrick Kane who the Blackhawks believe has "disrespected" the franchise to Winnipeg also be a fitting punishment?

#4 - The Buffalo Sabres

It's his home-town, it would be a very easy task marketing him to the local public assuming of course this entire situation is resolved. General manager Tim Murray of the Sabres has already demonstrated he's not afraid to make a big trade to acquire a top level talent.

Murray is working with over $12 million dollars in salary cap space at the moment and has taken advantage of conflict between a player and his team before when he acquired another Kane in Evander Kane from the Jets.

#3 - The New York Islanders

The Islanders are a team that have been struggling to find a way to take the next step with their current roster.

With currently over $9 million dollars in salary cap space and a general manager in Garth Snow who has proven to be very shrewd and the Islanders could look to a player like Kane to help them take that next step. A Kane and John Tavares pairing certainly would produce fireworks.

#2 - The Montreal Canadiens

Many believe that Montreal's lack of offensive production last season is what held them back, adding a forward like Patrick Kane could help them solve that problem.

Montreal however is only working with just under $3 million dollars in cap space some some serious moves would be required, perhaps a winger for winger deal involving Max Pacioretti who comes in at a very team friendly $4.5 million dollar cap hit. Chicago would need to take on another big contract, perhaps an Andrei Markov to make the financials work but could expect draft picks and/or prospects in return.

#1 - The Florida Panthers

The Panthers honestly seem like the most likely team to have inquired about Kane and the most likely to make a push to acquire him as well.

The team currently has over $11 million dollars in salary cap space so that hurdle is out of the way, the Panthers are a team loaded with young talent and a proven winner like Kane could really put them over the hump.

Florida also has a special connection to Patrick Kane as former Chicago general manager and current Florida general manager Dale Tallon who drafted Kane into the NHL.

Interesting. So there were settlement talks that apparently broke down. And there's a saying, a grand jury would indict a ham sandwich. So odds are the jury will hand down an indictment and barring a civil settlemt that chills the DA's office, Kane will be charged.

Kanes' cap hit is 10.5m per year......same as Toews.

Even worse. If he's charged and suspended lets see what favours the NHL does for the Hawks. I suppose the Hawks could claim he's in breach and terminate his contract. Not bloody likely.

It's what L.A. did.

Yeah and they're going to have to defend it in court. We'll see how that ends.
