Yes but signing a contract in bad faith can void a contract if it's argued, which means signing it does not entitle one to a bonus. Now the Bombers didn't bother to waste their time pursuing it because they probably just felt it was better to eat the cost, but facts are Durant acted like a child and stole money from the Bombers. You sign a contract you honour the contract, especially when you were well compensated to do so.

And you know what his situation, family and personal circumstances were that may have impacted his decision.....how exactly?

One could argue that he signed the contract in bad faith.

Argue all you want....Again it was literally a bonus to sign. Part of the reason that bonus clause was instituted was it gave import players a preferred reduced tax rate as an incentive to play in Canada. If you write in a conditional clause as a report and pass the medical as protection against the no shows it is not taxed at the preferred rate....hence the players desire for the signing bonus.

So here is the thing - WBB could argue that Durant modified the contract in a way that made the contract invalid by retiring before playing football.

Essentially the initial contract was - We pay you 70k on Jan 15, you come play football for us, during which we pay you an additional X dollars per year.
Durant modified the contract by retiring before playing - WBB pays me 70K on Jan 15, I retire before playing football for the club.

The problem for Durant is that contracts in Canadian law require that both parties receive consideration for a contract to be considered valid.  By modifying the contract and retiring before playing Durant has essentially made the contract invalid (WBB received no consideration in return for his signing bonus).  The only thing Durant could argue is that WBB received his not playing for another team in return for 70K.)

The consideration for Durant was he signed the contract. By definition in contractural law the signing of the contract fullfiled the one and only condition of a “ signing bonus”.

  4. Forgive but.....are we now going back to the import non import days? If these Mexican players are now being reclassified as non imports....so be it. But to believe that they can now compete with the caliber of players coming out of the NCAA is somewhat naive. While I appreciate the need to expand the revenue streams and audience base doing it on the assumption that Mexico is an actual talent pool is at best a complete stretch.

Every team should have tons of cap room with half to three quarters of every roster open. The question is, how many impact FA's will teams lose when other teams start chasing them?

Smart teams like Calgary set a budget for players by position. They don’t over pay for FA and Huff’s son does a good job of finding talent hence the stability of that franchise.

  6. The only deals being done right now are by clubs who are confident they have 2018 Cap space remaining.  The league deliberately held off on allowing off season bonuses to put the squeeze on players. The league has no real interest of need to rush into a new CBA , similar to the late date on the last CBA. The difference now is the players have now have no off season  money to tide them over.

  7. Hohoho.....fan.....by definition coms from the word fanatic. I have no expectation that there is any direct connection between objectivity and subjectivity.  Having spent 30 years in professional sport I understand that teams are dependent upon their “fan base”.  I attended a sports marketing conference and the speaker emphasized that given the fact that winning and losing is a 50-50 proposition the onus on team is to sell the notion of “hope”....hope for the future.

Forgive me if I don’t quality as a sports fan. I watch sports in hope of seeing great plays, execution, competition and athletisism where the outcome maybe in doubt and might hinge on the final minute, the last pass, shot or play regardless of the team, player or sport.

  8. The difficulty in elevating assistants or co ordinators to head coaches is the fact that head coaching is completely different in terms of your roll and responsibilities. It is difficult to predict how an individual will respond to that new roll. Dickenson had the benefit of transitioning from QB....clearly needing the ability to formulate, conceptualize, construct and execute an offence and then work his way up to becoming a head coach. It will be interesting to see what transpires in Hamilton, B.C. and Toronto next season.

On a positive note, and since we're quoting stats, in playoff games this regime is 1 for 4 now instead of 0-3.

With a footnote that win being against a team without a QB....ultimately pro sports is about winning. Clearly with that playoff win    we have solidified things for another year.
