Im not sure but Ill guess. I've seen 3rd degree murder also called voluntary manslaughter. So it might be they are giving a judge/jury two options (voluntary/involuntary). Or its just a way of charging for this particular crime in New jersey. Im guessing they will say he did not intend to kill her but acted in such a way (assault) that intended to harm her or should have reasonably known she would be harmed.
